Please carefully read and understand these terms and conditions (“Terms”). If you have any questions relating to these Terms please contact [email protected] before participating in the giveaway. Your legal rights are not affected by these Terms, which apply in addition to these Terms and do not replace them. Nevertheless, the Terms, as provided below, may limit Pickl’s liability to the extent permitted by law. By participating in the giveaway, you confirm that you accept these Terms.

About the giveaway.

1. For forty seven (47) days, Pickl is running a campaign in the UAE that gives a daily Pickl prize as scheduled on www.eatpickl.com/wet-summer. 
2. All giveaway entries automatically enter a draw for a grand cash prize of AED 10,000 that goes to one winner to be selected on September 1st, 2023. 
3. The daily prize winners will be entitled to the daily prizes as stipulated on  www.eatpickl.com/wet-summer starting from 17th, July 2023 and will be contacted via email with a digital voucher that can be redeemed until September 30th, 2023. 
4. The daily prizes are valid for single use only, they are non refundable, non transferable and cannot be exchanged for cash or any other menu item besides what’s mentioned in the digital voucher. 
5. If the daily prize selects one winner to win vouchers valid for a full year, the winner will get a physical card that they will have to show when coming to redeem their free items. The card will have the winner’s name, a unique reference number for the particular Pickl store that the voucher is valid in, the validity of the card and the Pickl store it can be redeemed in.

Eligibility. The giveaway is open only to participants who reside in the UAE. The giveaway is not targeted to anyone under the age of 16. You must be at least 16 years old to participate in the  giveaway. If you are at least 16 but not yet 18 years old, then you must review these terms with your parent or guardian and they must understand and agree to these terms in order for you to participate in the giveaway.

Duration. The giveaway contest starts on 17th July, 2023 and ends on 1st September, 2023. Only entries submitted before the end date will be considered. 

Winner Selection. The winner will be selected randomly from all eligible entries by the deadline. The winner will be notified by a phone call or email within two (2 ) days after the deadline. If the winner does not respond within  seven (7) days, another winner will be selected.

Publicity. By participating in the giveaway contest, the winner agrees to allow Pickl to use their name, photograph, voice and likeness for promotional and advertising purposes without compensation or approval incidental to the winner’s participation in the Pickl giveaway. Provided, however, if written notice (including email) is provided to Pickl by the winner requesting that Pickl cases using the winner’s likeness, Pickl has thirty (30) days to cease using the winner’s likeness in the manner set forth in the notice.

Liability. Pickl is not responsible for any injury, loss, or damage to participants or their property related to their participation in the giveaway contest. Participants agree to release and hold harmless Pickl and their affiliates from any liability, injury, loss, or damage resulting from participation in the giveaway contest or acceptance, use, or misuse of the prize.

Modification. Pickl reserves the right to modify, suspend, or terminate the giveaway contest without notice. Pickl also reserves the right to modify these terms and conditions without notice.

Our information practices and communications with you. Pickl’s Privacy Statement. The following Privacy Policy [https://eatpickl.com/privacy-policy/] describes our information practices, including how we collect, use and share information.

How we communicate with you. Through the online services, you may opt in to receive emails, text messages to the mobile number you provide to us or push notifications from Pickl’s. When you opt in to any of these types of communications, you understand and consent that you will receive marketing, transactional and other messages from Pickl’s. Pickl’s may use the information you have provided to us to communicate with you in accordance with the following Privacy Policy [https://eatpickl.com/privacy-policy/] 

Notices. Any notice under these Terms of if you wish to withdraw your consent, opt out and unsubscribe, please email [email protected].

Pickl’s intellectual property ownership. Any and all rights in the online services are and shall remain the exclusive property of Pickl’s or its licensors. For purposes of clarity, “online services” includes any and all content on the online services, such as, but not limited to, text, images, graphics, logos, page headers, button icons, images, audio clips, digital downloads, data compilations, software, trademarks, service marks, trade dress, audio, video, data and other materials (together, “content”) as well as any part of the online services. The online services are licensed, not sold, to you.  Nothing in these terms intends to transfer any such rights to, or to vest any such rights in, you. You may not take any action to jeopardise, limit or interfere with Pickl’s or its licensors’ rights.

Trademark information. Trademarks, service marks, and all graphical elements, including the look and feel appearing on the online services, are distinctive and protected trademarks or trade dress of Pickl’s or licensors.  The online services may also contain various third-party names, trademarks, and service marks that are the property of their respective owners.

Events beyond our control. Pickl’s has (and other members of the Pickl’s system have) no responsibility for Pickl’s failure to perform any of its obligations under these terms caused by or related to any event beyond Pickl’s reasonable control. If such an event occurs, then Pickl’s obligations under these terms will be suspended for the duration of the event; and Pickl’s may, but is not required to, use reasonable endeavours to find a solution by which its obligations under these terms may be performed despite the event.

Miscellaneous. 
These terms will be governed and interpreted pursuant to the laws of the UAE, notwithstanding any principles of conflicts of law; You irrevocably consent to the exclusive jurisdiction of the federal and state courts in  the UAE for purposes of any legal action arising out of or related to these terms or the online services.

The terms are written in  English. Any translation of the terms into another language is provided solely for your convenience, and to the extent there is any conflict between the two, the English version controls.

Each of the terms and conditions in these terms are severable and operate separately. If any of them are unlawful, void or unenforceable, then the remaining terms and conditions will remain in full force and effect.

If Pickl’s fails to insist that you perform any of your obligations under these terms, or if Pickl’s does not enforce its rights against you, or delays in doing so, that will not mean that Pickl’s has waived its rights against you and will not mean that you do not have to comply with those obligations.

Pickl’s may transfer its rights and obligations under these terms to another organisation or entity, but this will not affect your rights or our obligations under these terms. You may only transfer your rights or obligations under these terms to another person if Pickl’s agrees in writing.
